LYNCHBURG, Va. – The Lynchburg Commonwealth’s Attorney Office said it will drop the one remaining charge against Austin Rozdilski.

In May 2019, E.C. Glass High football player Dre’Yon Browley was shot and killed in the Meadows Apartments. His classmate Justin Barnett was also shot.

A jury later found, then 17-year-old, Rozdilski guilty for shooting Barnett, but not guilty of killing Browley. He was convicted on a lesser charge in December 2019 of one count of unlawful wounding in the shooting of Barnett.

Rozdilski claimed that Browley and Barnett held him at gunpoint on May 16. He also claimed he acted in self-defense when he shot twice from his own firearm.

In December 2019, Barnett testified that he sent a picture to Rozdilski of a firearm he claimed to possess and offered to sell to the other, but Barnett denied he actually possessed a gun. Thus, the gun Rozdilski said Barnett ad Browley used was not found.

Since the trial, Rozdilski’s attorney, Joseph Sanzone, said the weapon was located and requested his client gets a new trial with the newly discovered evidence.

A judge then agreed and decided to set aside the unlawful wounding verdict.

According to the press release, after consulting with Barnett’s family, Barnett made it clear he doesn’t want to pursue this matter further.

If the court grants the nolle prosequi request, the charge will be dismissed without prejudice.
