LAFAYETTE — Two men have been arrested on federal charges in connection with a Lafayette car break-in where an FBI agent’s gun and identification were stolen, court records show.

Marvin Raul Guerra, the man suspected of breaking into the car and taking a backpack, was charged with theft of government property. Jose Ochoa Gutierrez, his alleged accomplice who is accused of driving them out of the area, was charged with aiding and abetting theft of government property. Both men were released from jail at their first court appearance Tuesday, which prosecutors did not object to, court records show.

Though Guerra and Gutierrez were identified through surveillance video of the Feb. 20 car break-in at downtown Lafayette, authorities still have not recovered the agent’s Glock-22 duty firearm, nor have they recovered his identification — worth an estimated $1,000 on the black market — or key card, according to the criminal complaint. But the agent didn’t come up empty handed; investigators were able to recover some of his chocolate sea salt-flavored protein bars from the vehicle Gutierrez was allegedly driving.

Gutierrez allegedly confessed to the break-in after he and Guerra were arrested in San Francisco following the burglary, adding it wasn’t the only car break-in the two carried out that day, according to the complaint. He claimed that after they discovered the contents of the FBI agent’s backpack and realized they’d stolen from a law enforcement officer, they threw the contents out the window of the car, authorities said.

The burglary occurred around 5 p.m. while the agent and his wife were eating dinner in downtown Lafayette. The agent’s wife and at least one other person witnessed it but were unable to stop the suspects, according to authorities.

If convicted, the pair face a maximum 10-year prison sentence and a $250,000 fine. Guerra is next due in court March 22, and Gutierrez’s next court appearance has been set for Friday afternoon, court records show.
